1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website at cosmetictattoovancouver.com (the "Site") and the consultation intake system (the "Service") operated by Pink Ink Vancouver ("we," "us," "our"), owned and operated by Fawn Harper.

By creating an account, submitting an intake form, or otherwise using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Account Responsibilities

• You must provide accurate, current, and complete information when creating an account or submitting an intake form
• You are responsible for maintaining the confidentiality of your password and for all activity under your account
• You must be at least 18 years old to use the Site or submit a consultation request
• You agree to notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Consultation Requests — Not a Booking

Submitting an intake form through this Site constitutes a request for a consultation — it is not a booking, appointment confirmation, or guarantee of service.

• The artist reserves the sole and absolute right to accept, decline, or modify any consultation request for any reason
• A consultation request does not create an obligation for the artist to perform any service
• Pricing shown on the Site is for reference only and may vary based on design complexity, size, placement, and other factors determined during consultation
• Final pricing, design details, and appointment scheduling are confirmed only through direct communication with the artist

5. Health Disclosure and Safety

You are responsible for accurately disclosing any medical conditions, skin conditions, allergies, medications, or other health information that may affect the safety or outcome of a cosmetic tattoo procedure.

• Failure to disclose relevant health information may result in adverse outcomes for which the artist is not liable
• The artist may decline to perform services if, in her professional judgment, doing so would pose a health or safety risk
• Cosmetic tattooing is not a medical procedure. The artist is not a licensed medical professional and does not provide medical advice, diagnosis, or treatment
• If you have concerns about how a procedure may interact with a medical condition, consult a licensed healthcare provider before booking

7. Aftercare Responsibilities

Following your procedure, you will receive aftercare instructions. You acknowledge that:

• Proper aftercare is essential for optimal healing and results
• Failure to follow aftercare instructions may negatively affect your results
• The artist is not liable for poor outcomes resulting from failure to follow aftercare instructions
• Touch-up sessions due to client non-compliance with aftercare are not covered at no cost

8. Intellectual Property

• Custom designs created by the artist for your consultation are the intellectual property of the artist until the service is completed and paid for
• You may not reproduce, distribute, or use custom designs created for you without the artist's written permission
• Reference images you submit are used solely for consultation purposes and remain your property
• The Pink Ink brand, logo, and website content are the property of Fawn Harper / Pink Ink Vancouver

9. Photo and Portfolio Consent

By receiving services from Pink Ink, you may be asked separately whether the artist may photograph your tattoo for portfolio, social media, or marketing purposes. Photo consent is always optional and separate from these Terms.

• Photos used for portfolio will not include identifying personal information unless you give explicit permission
• You may withdraw photo consent at any time by contacting us
• Reference images and placement photos submitted through the intake form are used only for consultation purposes, not for portfolio or marketing, unless you give separate consent

10. User-Submitted Content

By submitting content through the Site (descriptions, images, messages), you:

• Represent that you have the right to share that content
• Grant us a limited license to use that content for the purpose of providing our services (reviewing your request, communicating with you, preparing for your appointment)
• Acknowledge that submitted content becomes part of your consultation record
• May request deletion of your submitted content at any time per our Privacy Policy

You agree to indemnify and hold harmless Pink Ink Vancouver, Fawn Harper, and their affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Site or Service
• Your violation of these Terms
• Your failure to disclose relevant health information
• Content you submit through the Site
• Your violation of any law or the rights of any third party

13. Termination

We may suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (limitation of liability, indemnification, governing law) will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Clark County, Washington.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
